Terms of Service

Welcome to CruiseProdigy. These Terms of Service govern your access to and use of the CruiseProdigy website, content, database, and interactive tools (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Operator

CruiseProdigy is operated by Charles Nicholson (“CruiseProdigy,” “we,” “us,” or “our”). If you need to contact us about these Terms, please email contact@cruiseprodigy.com or use our Contact page.

2. Informational Purpose Only; Not a Travel Agent

CruiseProdigy is an independent cruise research and planning resource. We are not a travel agency, booking agent, cruise line, tour operator, insurer, or personal travel advisor.

All content on the Site is provided for general informational purposes only. We aim to make the Site useful, current, and accurate, but the cruise industry changes quickly. Ships, itineraries, pricing, excursion availability, port logistics, amenities, dining, deck plans, policies, and onboard experiences may change without notice. You are responsible for verifying any details that matter to your travel decisions directly with the relevant cruise line, tour operator, booking provider, or other service provider before acting on them.

3. Eligibility

By using the Site, you represent that you are legally able to enter into a binding agreement under applicable law. If you use the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

4. Permitted Use

You may use the Site for your own personal, non-commercial use, including to research cruises, compare ships, review port information, and explore cruise-related content and tools. You may print or save reasonable portions of Site content for your personal reference, provided you do not remove any proprietary notices.

5. Prohibited Conduct

You agree not to:

  • Use automated scripts, bots, spiders, scrapers, crawlers, or similar tools to access, extract, monitor, harvest, or copy Site data or content.
  • Use the Site or its content to build, train, fine-tune, benchmark, or improve any database, search product, model, or automated system without our prior written permission.
  • Reproduce, mirror, cache, frame, or republish substantial portions of the Site for commercial purposes.
  • Attempt to access non-public areas of the Site, underlying databases, APIs, admin tools, or systems not intentionally made available to you.
  • Interfere with or disrupt the Site’s security, performance, or functionality.
  • Introduce malware, malicious code, denial-of-service activity, spam, or other harmful material.
  • Use the Site in any way that imposes an unreasonable load on our infrastructure or third-party services.
  • Submit false, infringing, defamatory, unlawful, or abusive material through our contact channels.
  • Use the Site in violation of any applicable law or regulation.

6. Intellectual Property

The Site and its contents, including but not limited to text, editorial content, ship dossiers, port guides, design, layout, branding, graphics, code, and compilations of information, are owned by CruiseProdigy or used with permission and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, publish, modify, create derivative works from, publicly display, commercially exploit, or otherwise use Site content without our prior written permission.

“CruiseProdigy” and related branding elements are our trademarks or service marks. You may not use them in a way that is likely to cause confusion or imply endorsement.

7. User Submissions and Feedback

If you send us a message, correction, suggestion, inquiry, idea, photo, or other submission, you represent that you have the right to send it, that it does not violate the rights of any third party, and that it does not contain unlawful or malicious material.

You retain ownership of the material you submit, but you grant us a non-exclusive, worldwide, royalty-free license to receive, store, review, reproduce, and use the submission as reasonably necessary to respond to you, evaluate it, improve the Site, and maintain our records.

We are not obligated to publish, use, or respond to any submission.

8. Third-Party Links, Vendors, and Affiliate Relationships

The Site includes links to third-party websites and services, including cruise booking providers, excursion operators, gear retailers, and other partners. We may participate in affiliate marketing programs and may earn a commission if you click certain links or make a purchase through them.

Third-party websites, products, and services are controlled by their own operators, not by CruiseProdigy. We do not control and are not responsible for third-party content, pricing, availability, booking terms, cancellation terms, waivers, shipping, refunds, privacy practices, accessibility, or business practices. Any transaction, booking, or dispute involving a third party is between you and that third party.

9. Accuracy, Availability, and No Warranties

We work to keep CruiseProdigy useful and reasonably current, but we do not guarantee that the Site will always be accurate, complete, current, secure, or uninterrupted.

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not guarantee that the Site will always be available, that the Site will be free of errors or omissions, that the Site will be free from viruses or harmful components, or that the information on the Site will always reflect the latest real-world conditions.

10. Limitation of Liability

To the fullest extent permitted by law, CruiseProdigy and its owner, operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, travel value, or other intangible losses arising out of or related to your use of or inability to use the Site, errors or omissions in Site content, changes to itineraries, ships, ports, pricing, or third-party offerings, decisions you make based on Site content, missed connections, missed excursions, booking issues, travel disruptions, or your interactions or transactions with third parties linked from the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site will not exceed the greater of $100 or the amount you paid us directly, if any, in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless CruiseProdigy and its owner, operators, affiliates, service providers, and licensors from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Site, your violation of these Terms, your violation of applicable law, or your submission of material that infringes or violates the rights of another person or entity.

12. Suspension or Termination

We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to all or part of the Site at any time, with or without notice, if we believe you have violated these Terms, misused the Site, or created risk for us, other users, or third parties.

We also reserve the right to modify, suspend, discontinue, or remove any part of the Site at any time without liability.

13. Copyright Concerns

If you believe that material on the Site infringes your copyright, please contact Charles Nicholson at contact@cruiseprodigy.com with enough detail for us to identify the material at issue and evaluate the claim.

This section is intended as a practical reporting channel and is not a statement that CruiseProdigy has designated a DMCA agent with the U.S. Copyright Office.

14. Changes to the Site and These Terms

We may update the Site and these Terms from time to time. If we make changes to these Terms, we will post the revised version on this page and update the “Last Updated” date above. Changes become effective when posted unless otherwise stated. Your continued use of the Site after revised Terms are posted means you accept the updated Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state courts located in Tippecanoe County, Indiana or, if federal jurisdiction exists, the United States District Court for the Northern District of Indiana, Lafayette Division, and you consent to the personal jurisdiction of those courts.

16. Notices

We may provide notices to you by posting them on the Site or, where appropriate, by responding through the contact information you provide. You may send legal or general notices to us at contact@cruiseprodigy.com unless we specify a different address for a specific kind of notice.

17. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and CruiseProdigy regarding the Site.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a reorganization, sale, transfer, or other business transaction.

Sections that by their nature should survive termination or expiration of these Terms will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, venue, and miscellaneous provisions.
